The Agrica Platform is designed to provide You the information related to the business transactions including but not limited to the sales transaction, invoice status tracking, quantitative study of sales, distribution of Your products by Your channel partners (herein collectively “Entrepreneurs”) while using the Agrica Platform.

Reference to You here means: The beneficiaries of the data either provided by the Distributors and/or the data analytics available while using the Agrica Platform.

Reference to Distributors here means: The channel partners using the Agrica Platform for providing data for our analytics.

We collect the information on Your behalf from the Distributors having access to Agrica Platform. This privacy policy does not apply to any information collected offline or by any other means other than Agrica Platform. This policy explains the usage and restrictions of the information that are provided by the Distributors while using Agrica Platform and You expressly agree to be bound by the terms of this Privacy policy. And, if You do not agree, please do not access or use this platform.

This policy details the critical aspects governing the Personal Information available with DforD which is in possession and operated by Data For Decision Technologies Solutions Private Limited.

How does DforD define “Personal Information”?

For the purpose of this privacy policy, “Personal Information”, is any data provided by the Distributor while using Agrica Platform which relates to an individual who may be identified from that data, or from a combination of data provided by Distributors and other information which is in possession of DforD maintained in an accessible form.

How does DforD collect Distributors’ Information online?

When Distributors access the platform, we collect and store the information which is provided by Distributors from time to time:

Personal Information submitted through Agrica Platform: We collect Personal Information that Distributors fill into data fields, such as, Name, phone number, and e-mail address. We may also collect your photo.

Business needs: The Personal Information and other information provided by the Distributor should be used as per the agreement between Bayer Crop Sciences and Distributor, such as, PAN Number, payer code, and loan account number.

We use Personal Information for the following purposes:

• To create users ID and login credentials
• To identify users once registered with DforD
• To contact users and respond to users questions (if any)
• To provide access to desirable content based on users preferences
• For business purposes, like offer users the opportunity to receive notification regarding certain products and services or to invite users to participate in survey about Your products, sales loyalty programs, and other variety of services offered by You

Third party uses:

Information collected by DforD in whatsoever manner via this platform, is possessed by DforD and may be used by DforD on Your behalf. We may give access to this information to any third-party service providers for technical, administration of the platform, user administration, research and development and other purposes. Your use of the information shall be restricted to the information related to your services and products used by Distributor. You hereby agree not to use or get access to information which are not relevant to Your business. Additionally, DforD may share, sell or otherwise transfer such research and statistical or intelligence data in an aggregate form to its parent company, group companies, affiliates, subsidiaries, associates, suppliers, vendors, sister concern, service providers, service partners, clients and other third parties. DforD hereby understands that the information related to Your services and products including analytics to the data available with us are confidential to You and will be kept confidential and will not be shared with Your competitors.

To disclose Information if required to do so by law or in the good faith in belief that such disclosure is reasonably necessary to respond to any court orders or regulatory requirements or any legal proceedings.

What security precautions DforD has for Personal Information?

We adopt reasonable and appropriate security practices and procedures including administrative, physical security, and technical controls in order to safeguard of Personal Information. Once the Personal information is in our possession, we adhere to the security guidelines to protect users information which is hosted in the cloud platform in Bayer AWS. However, by using the platform, You accept the internet security implications of data transmission over the internet and the World Wide Web which cannot always be guaranteed as completely secure and therefore, there would always remain certain inherent risks regarding use of the platform. You are responsible for ensuring the protection of login and password records for your account.

How does DforD protect the privacy of Children Information?

We do not knowingly collect or use any Personal Information from children under the age of 18 and use of the platform is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If users are under the age of 18 years’ then user must use the platform, application or services under the supervision of users parents, legal guardian, or any responsible adult.

How does DforD retain data?

Data retention is as per the terms and conditions of Bayer AWS Policy.

Your Limitation:

You hereby agree to use the information including Personal Information of Entrepreneurs exclusively for commercial purposes as agreed under Master Services Agreement. Your use of Information should not be for illegal purposes or purposes not acceptable by the laws of the land. Your use of the information shall be restricted to Your products and services and not of Your competitors. You will not divulge the rights to any third party without DforD written consent. DforD hereby clarifies that its not the owner nor the provider of any Personal Information, DforD is only a possessor of Personal Information available on the Agrica Platform. DforD takes no liability for any claims either directly or indirectly made by You, Entrepreneurs and/or third parties for the use of the information including Personal Information by You via this agreement.

Your Consent:

Once you register yourself on to the Agrica Platform, You consent to the collection, use and storage, disclosure and otherwise processing Your information and Distributors information (including Personal Information) on Agrica Platform in accordance with this Privacy policy.

Change in Privacy Policy and Governing Law:

Current version of privacy policy is version 1.0. DforD is free to upgrade the policy versions from time to time. You are hereby requested to frequently visit the Privacy Policy page to get latest updates. Currently the Personal Data Protection Bill, 2019 is yet to be passed by the legislation, the terms of this policy may be changed accordingly once it becomes a legislative Act. This privacy policy is governed by the laws of India and is subject to exclusive jurisdiction of courts of Bangalore in case of any disputes.

This digital finance application AGRICA (hereinafter the “App“) is provided by Bayer Pakistan (Private) Limited | 0084 | Pakistan (hereinafter „us“ or „we“). For further information regarding the provider of the App, please refer to our imprint.

In the following we wish to provide you with information on how we handle your personal data when you use our App. Unless otherwise indicated in the following chapters, the legal basis for the handling of your personal data results from the fact that such handling is required to make available the functionalities of the App as requested by you (Art. 6(1)(b) General Data Protection Regulation)

Accessing our app

In order to make available to you the services of our App, it will transfer the following information to us, every time you use our App:

Personal Information submitted through Agrica Platform: We collect Personal Information that Distributors fill into data fields, such as, Name, phone number, and e-mail address. We may also collect your photo.

• IP address
• Date and time of access
• Time zone difference to Greenwich Mean Time (GMT)
• Operating system information
• Status of access/HTTP status code
• Transferred volume of data
• Language settings, version of app
• Log-in credentials (username and password)

Moreover, to protect our legitimate interests, we will store such information for a limited period of time in order to be able to initiate a tracking of personal data in the event of actual or attempted unauthorized access to our servers (Art. 6(1)(f) General Data Protection Regulation).

Registration and login

In order to be able to use certain services of our App, you need to first register an account with us, where you are able to determine your personal login credentials that you need to be able to log into your personal account. For this registration and subsequent login procedure, we collect the following information about you:

• Name and surname
• Contact data (e.g. postal/email address or phone number)

We process this personal data in order to provide you with an access to the services of our App. They are deleted in case you deactivate your user account.

Recipients of personal data

Commissioned processing

For the processing of your personal data we will to some extent use specialized service contractors that process your data on our behalf (e.g. for IT-Support or cloud services). This includes in particular also: Data for Decision Technologies Solutions Private Limited, which created and maintains this application for us. Such service contractors are carefully selected and regularly monitored by us. Based on respective data processing agreements, they will only process personal data in accordance with our instructions.

We may share your personal data with our affiliates from the Bayer Group, where necessary for the purposes described above.

Information regarding your rights

The following rights are in general available to you according to applicable data privacy laws:

• Right of information about your personal data stored by us;
• Right to request the correction, deletion or restricted processing of your personal data;
• Right to object to a processing based on legitimate interest or public interest, unless we are able to proof that compelling, warranted reasons superseding your interests, rights and freedom exist, or that such processing is done for purposes of the assertion, exercise or defense of legal claims;
• Right to data portability;
• Right to file a complaint with a data protection authority;
• Where you have provided your consent to the processing of your personal data, you may at any time withdraw your consent with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the withdrawal.
